Naming Beneficiaries: The Page People Get Wrong
This page takes precedence over your will. Errors affect the payout directly.
The least conspicuous page of an application is often the most decisive one at claim time. A life insurance death benefit is paid according to the beneficiary designation on the policy, and generally is not controlled by your will — what your will says cannot change who is named on that page.
Primary and Contingent
- Primary: the person or people first in line. It can be one individual or several splitting stated percentages (which must total 100%)
- Contingent: takes effect only if every primary beneficiary predeceases the insured or cannot receive the benefit
Many policies are submitted with only a primary named. If the sole beneficiary dies first — or in the same event — and no contingent exists, the benefit typically falls into the insured's estate and moves through court administration: slower, costlier, and potentially exposed to creditors.
Minor Children Cannot Receive Directly
This is the most common mistake. Naming a minor child outright usually means the insurer will not hand the money to the child; it waits for a court-appointed guardian or property administrator, and the funds are frozen until then.
Workable alternatives generally include naming an adult guardian, establishing a trust and naming the trust as beneficiary, or using a custodial arrangement recognized in some states. Which one fits your family is a legal planning question and should be confirmed with an attorney — the rules vary by state.
Per Capita or Per Stirpes
When several children are named and one predeceases the insured, where does that share go?
- Per capita: divided among the surviving named beneficiaries
- Per stirpes: passes to that beneficiary's own descendants — your grandchildren
The outcomes can differ completely. Policies usually offer a checkbox; if it is left blank, the policy's default rule applies, and that may not be the one you intended.
When to Re-check This Page
- Marriage or divorce — failing to update after a divorce is the costliest error on this page; ex-spouses remaining as named beneficiaries is not rare
- Birth or adoption of a child
- A beneficiary predeceasing you
- A change in a beneficiary's name, marital status, or contact details
- Any estate tax planning or provision for a family member with special needs
Three Practical Notes
- Identify people precisely: full legal name, relationship to the insured, date of birth. "My wife" or "my children" creates evidentiary problems at claim time
- Do not stop at the policy: 401(k)s, IRAs, and some bank accounts carry their own beneficiary designations under similar rules. Review them together
- Keep a record: request written confirmation from the insurer after any update, and make sure your beneficiaries know the policy exists — a claim begins with someone knowing to file one
Beneficiary designations interact with estate, tax, and guardianship planning. Confirm your arrangement with your attorney or CPA; the insurer's official policy documents and forms govern.
